Open Letter To The Elections Commissioner

Dear Mr. Dayananda Dissanayake,

You are reported to have said yesterday (19/01) that you were withdrawing the Competent Authority you had nominated to monitor the state media, on the grounds that the relevant authorities had flouted his orders. You have also expressed disappointment with the Police Chief regarding his failure to remove illegal posters and cutouts of presidential candidates and to curb the violence unleashed by their supporters. You have said that you were “disappointed” and would quit after the presidential election.

Let me say on behalf of millions of voters that we on our part are much more disappointed with your performance as Elections Commissioner. We are disappointed that one of the two most important rights that we can directly exercise as citizens in a democracy (the right to elect a government and the fundamental rights guaranteed by the constitution) is being undermined by your failure to act to safeguard it.

Under the provisions of the 17th Amendment of the Constitution you have all the powers of the Elections Commission until it is set up. But you talk and act as if you are impotent. Instead of taking charge and using the powers and facilities at your disposal, you have adopted a subservient attitude to the Police Chief and the state media bosses and have issued half hearted appeals to them to behave and act according to the Elections Law. And when they fail to follow your instructions, you withdraw the Competent Authority appointed by you and express your disappointment. You talk of quitting, like a child who wants to take his marbles and go home when the game is not going his way. For goodness sake, you are the Elections Commissioner and this is not a game!

You have argued that you are not getting the cooperation you want from the state media and the police. Well, you can have recourse to the law and bring these miscreants before the courts. And if that fails, you can get on television and tell the nation what is happening and demand that the state media and police act according to the law. Take your case to the people. People power and public opinion can be a mighty force and the powers that be will have to respect them. You even have the power to set aside the election!

On the other hand, you can continue acting as you are now doing — do nothing and stand by silently while all the election laws are being flouted — and go down as the worst Elections Commissioner in the history of the country. Who knows, you might be rewarded with an ambassadorship or other high post on your retirement!

      I wonder why the masses can go against the inaccuate manipulated results? why is that the parties did not protest yet ? Can t one collect sufficient evidence to prove all these easily? Me being away from the country I feel why can t the masses join hand in this moment, otherwise, he may even do whatever he wants to in the years to come. Mugabe of Simbabwe could be second to MR.

    A spineless commissioner can just do that, what else? Presidents always appoint spineless people so that they don’t challenge their boss and loose their security details. Who has the guts like SF? 17th amendment is the answer for all this. First job, if SF elected will be appointing the CC according to the 17th amendment. It is part of his promise to abolish/reduce executive power of the President and have the proper check and balances to the highest job of the land. MR has violated all the election laws and want to be re-elected. How funny is that?

    Dr. de Alwis is right and Vintage Voter too is right. We are a very passive Nation bound by religions and cultures. Our souls are purified by words like sympathy and gratitude and we sadly watch while others sacrifice their precious lives for our land and at the same time when some others flout all rules and regulations disgracefully and plunder our wealth for their personal benefit.

    If you put a secret stamp on the ballot papers on election day before releasing the ballot papers that is handed over to the voter and checked at the time of counting the votes, you can void those fake ballot papers. It is only you and only your polling staff can prevent fake ballot papers being counted. You have the power to do anything that can prevent fake ballot papers being counted. Will you do it or give way to the power

    In 2005 Elections I couldn’t vote because my name not appeared in the Register.We have submitted the Form properly to the Grama Sevaka. The GS cut my name because I was serving far away from my home town as an engineer. I am sure the same thing happend to Hon.SF too. He was serving out side Ambalangoda for a long time.

      there is an another posibility, in a country vote rigging and even electroinic data manipulations are openly being done, – how do we know whether they intentionally removed SF´sname from the register in order to prove the nation that he cant be the president, according to their pre plans. … Anyway, any forms of abuses are allowed to them.

    Poor guy was ejected from his seat at 3.00am on 27th and Thugs have taken the control of the Election Results. This victory is a result of that. This the democracy of our country.

      But my question is why cant he the election commissioner act against all these ? what can happen to him if he even today could stand against the announced results. In the worst scenario, he can leave the country and ask for asylum, but doing so, he could be a hero to the nation, atleast 50% of the population will respect him more than to a president who got elected through inaccurate results.

        If the Election Commissioner really wants democracy in Sri Lanka to prevail and he really loves our mother Lanka , all that he has to do is to come out publicly and inform the country exactly what happened on the 27th night at his office as well as at other counting centres.
