Rigging: Truth Or Fiction?

If there was ever a common topic in the aftermath of the Presidential Elections 2010 and especially after the results were announced it was this: RIGGING. Not a soul was spared of this topic. The entire country it seemed were debating how the election was rigged or how it was not.
The pro Rajapaksa supporters claimed it was sour grapes whilst the defeated candidate anointed himself the president who was robbed of victory.
We examine here step by step as to how rigging could or could not take place. After careful examination of the process, it would appear that the most logical explanation is that when the count became obviously in favour of one candidate the losing candidates’ polling agents left the counting centre before the final tally was completed. Once having departed from the counting centres, these polling agents would have no knowledge at all as to what happened thereafter – that it self does not necessarily mean that rigging took place: it merely points to the fact that while the counting progressed and as one bundle grew bigger and bigger, the losing side took a decision to leave the centre, conceding defeat.
There are claims however that the polling agents who left the centres were virtually forced to leave through intimidation and threats and coercion. However Sri Lanka has had elections spread over the past 62 years and the process is well known and there can be no new, untried and untested methodology for rigging. The threats are not new and all the parties would have been prepared for the worst. At least they ought to have expected the worst. If they did not, then they stand accused of grave naivety.
Significantly the Elections Commissioner stated last week that there were no threats or incidents within the counting centres. The reports of threats and intimidation and damage to property belonging to party polling agents are outside of the centres and therefore becomes a matter for the police and is clearly not under the purview of the Elections Commissioner.
There is no excuse of rigging or coercion and intimidation. However, the reality is that there was no need to invent the wheel again. All parties party to the election process have for long engaged in rigging at some time or other. The checks and balances are only thought of at the last moment only to be forgotten soon after an election – surfacing just as the results get announced.
The politicians of this country of every hue and persuasion must stand condemned for their utter lack of focus and direction in addressing this anomaly. They must put in place measures that are not so easily violable. The simple expediency of having live cameras, broadcasting on specially opened channels and on the internet for each counting centre would quite easily dispel any threat and intimidation. Not one single politician worth his salt has put his or her mind to this important aspect of the electoral process. Not one. If they have, the public have not been made aware of that.
It is indicative of the mismanagement of Sri Lanka – spread over 62 years of independence. The lack of will to turn it into an effectively managed nation is shocking. After 62 years of independence and innumerable elections, the fact that the politicians are arguing about electoral fraud is stupendous.
Here’s how it works:
1. Voter turns up at centre with the National Identity Card. Therefore impersonation is virtually non-existent, technically. However the possibility of fraudulent identity cards is a reality. The fraudulent identity card must be registered in the 2008 electoral list. Therefore any fraud would have had to be planned well in advance. Copies of the 2008 electoral list would be available with all parties and therefore any discrepancies would be easily identified.
2. Each candidate has polling agents at each polling booth and counting centre.
3. Voter’s name is announced and each party will check their lists to see if voter is present on the list.
4. Finger marked with ink and ballot paper given
5. Vote cast – the ballot paper is serially numbered.
6. The number of issued ballot papers must tally with the number of ballot papers cast.
7. If there are any ballot papers not issued to a voter who stays away, these papers must be returned and separately tallied.
8. After voting the sealed ballot boxes – sealed in front of all candidates’ agents – are transferred under armed guard to the counting centre.
9. Transport carried out by police.
10. No impediment for agents to follow the vehicle.
11. Sealed ballot boxes are opened in front of the agents at the counting centre.
12. Officials of Elections Commissioner and candidates are present.
13. Counting begins.
14. Each candidates votes are separated.
15. Each candidates votes are bundled into lots of 50 sheets.
16. Bundles of 50’s then counted.
17. Tally made between polling both and counting centre numbers.
18. Results are entered onto carbonised paper and each candidate is given a copy certified by the Elections Commissioner.
19. One copy transmitted to Elections Commissioner’s office.
20. In 2010 this transmission was by e-mail.
21. Transferred to the computer at EC offices.
22. Results announced
Fraud is possible when:
Counting is going on, a ballot in favour of one candidate could end up in the pile of another candidate. This is highly risky as it assumes that the candidates’ agent is not paying attention. Therefore candidates choose their agent supposedly wisely!
Ballot boxes could be introduced to the counting centre. Difficult to check but also difficult to accomplish as the tally sheets would need to be considered.
And here is another theory:
The results announced through the mass media, in a summarised format, was as stated below:
Total Valid Votes: 10,495,451 - 74.4%
Total Registered Votes 14,088,500 - 100.0%
Rajapaksa’s Share of
the Votes 6,015,934 - 57.3%
Fonseka’s Share of
the Votes 4,173,185 - 39.8%
Votes Shared by other
Candidates 306,332 - 2.9%
The electoral manipulation could have been a simple statistical adjustment undertaken in the Election Commissioner’s office in Colombo, as can be observed from below.
When the voting numbers were received through the computer from the electoral counting centres, the computer operator in transmitting the figures for purposes of printing in the format required for the Commissioner’s signature, transfers 10,000 votes from Fonseka’s to Rajapaksa’s votes. He also alters the percentages of the votes accordingly. All other numbers and particulars remain unchanged.
The election is conducted on the basis of 160 electoral districts. Of these 160 electoral districts 20 districts in the north and east were not taken for voting adjustments, because the polling was considerably low and also, importantly, the Sinhala community is a very small minority in these districts. In the circumstances, the number of electoral districts available for vote adjustments were only 140.
To determine the true polling numbers obtained by the two main candidates, one has to reverse the vote adjustments undertaken in the Election Commissioner’s office.
These revised numbers will show, as given below, the true results of the 2010 Presidential Election.
(i) 140 Electoral Districts x 10,000 votes will amount to 1,400,000 votes.
(ii) The above number added to Fonseka’s published figure will be – (4,173,185 + 1,400,000) = 5,573,185 votes and 53.1%
(iii) Rajapaksa’s revised vote will be – (6,015,934 – 1,400,000) = 4,615,934 and 44.0%

Dear Mr Dissanayake
(February 05, London, Sri Lanka Guardian) Recent events following the Presidential election have put you on the negative limelight, due to your confusing and contradicting comments made head down without looking at the audience.
Lots of accusations are leveled against you. Some have been denied. The manner in which you are responding to the issues surrounding the conduct and the outcome of the election is further confusing the citizens like me. I plead with you to look at the face of the world at large and tell the truth to the following serious questions.
Question 1: According the ‘The Times’ report filed by Jeremy Page ‘The President’s brother and adviser, went to see the Independent Elections Commissioner just before the latter announced the final results. The ministers denied that Basil Rajapaksa was meeting the commissioner, and said that he was asleep at the time, but Ms Wenger said that she saw him leave the Commissioner’s office immediately after the press conference’.
My simple question to you is: Did Basil Rajapakse meet you just before the election results were announced? If so, what was discussed or ordered by him?
Question 2: Sri Lanka Guardian in its exclusive news reported that you and your wife were held in captivity in the Presidents official residence Temple Trees and intimidated to obtain your consent to announce the government favoured comments on the outcome of the election and also to get your resignation announcement withdrawn.
In the public interest and to earn the public confidence, would you kindly confirm by looking at the audience straight on their face without fear or subdued voice, whether this story is true or false.
Question 3: The Lankanewsweb in its latest news headlined ‘A group of Army personnel had imprisoned Election Commissioner’s wife and daughter at Water’s Edge on the election day’.
Once again in the public interest, will you be able to confirm this story is true or false.
I understand that you are not permitted to travel overseas until the General Election is over. If this is not true, will you be able to travel to the UK or any other healthy democratic country and make a public statement on the issues surrounding the election. I am prepared to fund your first class flight ticket for your visit, as I consider your public statement in a respectable place without any fear of recrimination will be very useful for Sri Lanka’s future.
Finally, with the very serious accusations levelled against you on the conduct of the Presidential election, how do you expect the citizens of Sri Lanka to consider you are independent to conduct the forthcoming General Election? Will you make a public statement to confirm what action you will be taking to overcome the difficulties you have encountered during the Presidential election to ensure the difficulties are not repeated with your backing?

My Dear Dayananda,
I thought I must write to you because you seem to be the man of the moment these days, grabbing headlines even more than Mahinda maama who won the election.
Of course, Dayananda, the other reason why I thought I must write to you was because I heard you say that you would continue to hold your job-because if I am not senile and losing my memory like some public officers who should have retired a long time ago-I distinctly remember you telling us that after that election, you would not step into your office!
Pardon me, Dayananda, there was a time right until this election, when we respected you and were happy that a man of your integrity was holding the responsible job that you have, even if we lesser mortals don’t have luxuries like independent elections commissions.
Why, even during this election we marvelled at the way you complained — tearing the little hair that you have remaining — about the state media and the police and how your instructions to them found their way invariably to the waste paper basket.
Of course, we expected you to do something about it rather than being satisfied with summoning press conferences and complaining endlessly. To be honest, when you did nothing, we were a little disappointed.
Then we were a little surprised when you said-before the election, mind you — that the election will be free of fraud and fair and that there was absolutely no room for anyone to tamper with any vote. You were either being very naïve or very ingenious — and now we know which one it was!
But even then we had some confidence in you because you did say that you are disgusted with the entire system and will not step into your office after the big election-although, frankly, there were quite a few who thought that it wouldn’t make a difference anyway!
Then we had all that drama about the big election, and what a bagful of rumours we had that day! Why, if you were contesting for one of those ‘Super Star’ competitions, you would have won hands down — there were so many SMSs in your name that day!
But lo and behold, you did make an appearance at the end of it all to give your certificate that the election had been ‘successfully concluded’. But it was not before saying once again that you had gone well beyond the call of duty and that therefore, it would be your last election.
We were a trifle surprised to hear you praise the Police Chief who you said was one of the best. After all, it was only a few days ago that you yourself had said that you wouldn’t write to him anymore because all those letters ended in the waste paper basket! The Police Chief was the best, yes-only we didn’t know what he was so good at until much later!
We did sympathise with you even on that day after the election, because you spoke of the ‘aathathiya’ that you had been subjected to and how there would be no one to look after you, should any harm befall you. And, as many people remarked, the plight that you were in showed in your face that day.
So, imagine our surprise, dear Dayananda, when you turn up just a few days later with not even enough time to have a decent vacation to announce that you would do it all over again which I suppose would be from the same office that you vowed not to set sights on after the previous big election!
Where on earth did all that ‘aathathiya’ disappear, dear Dayananda? If you found a miracle cure for it through some faith healer, please do let all of us know about it because, after hearing that you will preside at the next election, most of us are having that same ‘aathathiya’ these days!
Of course, Dayananda, there are many who are now saying that with Commissioners like you, who needs elections? Why, we could even save the country a lot of money by not having a general election and having a ‘computer ‘jilmart’ instead!
Anyway, I have to stop short of wishing you a happy retirement after the next elections because, who knows, they may even keep you going till 2017!

I wonder why opposition parties try to cheat people this manner. They have carbonized copies of each poling division. Simply what they have to do is to sum up the votes of Fonseka and Mahinda and check whether they are tally with the results issued by the Election Commissioner. As these carbonized papers are directly from the counting centres, they should not be subjected to computer Jilmart. Without doing such simple exercise, they want to propagate lies after lies to cover up their faces from this bad defeat. Even a grade 5 student can do such arithmetic. I do not know whether there is any opposition party member who has passed grade 5 exams. I beg from opposition leaders not to give this type of ridiculous reasons for their defeat. Find alternative and rational arguments to challenge the government. Unless you have to face another humiliating defeat at the next general election because people are not such fool to swallow all your rubbish arguments.

This is a serious allegation against the Department of Elections and the commissioner of Elections. They might clarify the situation to the public. Public do not see any discrepancy in the election results as mentioned in this article.

of the EC at the time of announcement on 27th. It appeared that he was inwardly hoping “Oh! god save me and my family from these murderers.

Leader is gradually losing its credibility. EC’s two speeches if examined, in the second speech he failed to even mention about the State media disregarding his directions. For me the second speech was made to take the sting out from the first and validate all actions of the EC and his staff. EC’s subsequent conduct makes the accusations made by SF camp more plausible. Please read the storey given by Jayalath Jayawardene (published in some other journal) as to what happened at Negombo counting centre where he was present.
Who cares about EC mate? they are outdated colonialists! All the leaders in the EC having erection problems; eg France, Italy. We will go to China, Iran, India. We have good friends in the UN, the Moon guy and his sidekick, Nambiar the Indian.

Rather serching for ballot papers in dustbins, Why the hell they cannot collect all carbon copies from their agents and proove that final result is wrong ?
Counting is held in the Counting Centre of the area under the supervision of the Returning Officer who is the Government Agent of the District. (District Secretary). Once the counting is concluded, un-official result of the electorate is announced in the Counting Centre and those who at the Counting Centre is aware the result, several hours before the Official results are announced by media aftyer the Official announcement by the Commissions. As stated in the article, all Counting Agents of the Candiates place their signatures on the Carbonized Result Sheets of the Centre. Therefore, there should have been aware the actual result, hours before the official result and they can compare the results in the corbonized paper with the results annonced by the Commissioner. Therefore, this analysis is a farce.
EC himself said to the public, that there were counting centres,that all sorta of abuses occured, as to a manner one cant compare them with any previous times sofar. And he further confirmed ( in his speech on the 27th) that safety of ballot boxes cant be assured, even though he came with totally contradictory details following a few days.
And EU wants to know whether all these abuses caused him to get reelected. That is why one of them have hailed it as a free and fair election which one can name as- MR got elected again as thepresident of lanka.
Now commissioner has nt yet been able to argue why bundles of ballot papers were found burnt in the area of R pura.
I wonder why even interllecutals of the country feel that MR has got reelected … while seeing evidences that even 10 year olds can easily say, it was ABSOLUTELY not a fair election. Even if you have got all the evidences, you may not be able to prove them to thepublic easily, since governing administration is tricky and apply all the tactics to fool the nation.

I was told at 6.30 in the morn from Snr Chief counting officers my colleagues in Matara, Nuwara Eliya Anuradhapura. By then the counting was over!! They said sic Nuwara Eliya the PA lost by 29,000, other than Matara town all others massive victories over 60% at 6.30, Anuradapura over 60% in the morning long bef any computer tallying and straight from the district the first part of the story is correct it has happened in almost all previous elections if yu loose badly yu dont wait. Don,t sling mud at the public servants of this country by slinging some absolute goose dirt why does the opposition ask those public servants who did support them and who counted whether such things happened in the norm!!

The main question is officially where is the Election Commissioner supposed to be during the entire process of completing this major Election; definitely not a Temple trees, for one thing that may be the place where the President resides but the more important issue is that that where a Candidate resides.
If there was anything called a Coup against the State the President and the Govt. was or would have been informed of it prior to the declaration of the P/Elections.

Take a lesson from the former Communist country-Ukraine-the Election Commissioner was not kept in the Present Presidents house!There was what is called transparency-as per independent Observers report- and finally the Opposition is siad to be heading for victory- the current President has not resorted to any form of pressure on the Authorities- nor are her brothers and sisters seen running around to counting centres.After 60 years of democratic rule Sri Lanka is going backwards- no progress-no transparency- no indication of improvement in the quality of life of our people- we are still going on the foot board- poverty alleviation only on paper-hardly in progress in Education- But our Politicians are very wealthy- they are well off!

Your entire argument is destroyed with the one line, a fact you do not seem to know: counting is done in the presence of each party’s agents and foreign monitors. None of whom reported fraud. SF and Mangala have still not been able to point out where their allegations come from. And neither can you.
