No Legal Provision to Present General Fonseka Before Court Martial
JVP parliamentary group leader, Anura Kumara Dissanayake said there was no legal provision to present former Army Commander, General Sarath Fonseka before a court martial and that the General’s lawyers would go before the court martial to give reasons.
He said that General Fonseka could not be brought before a court martial according to the Army and that a habeas corpus has been filed before the Supreme Court requesting his release.
Dissanayake claimed the government was planning to bring General Fonseka before a court martial to convict him in order to create an impression among people that there was no point in voting for him at the general election.
Sarath . N . Silva will learn his lesson this time !
This so called impartial ex chief justice very clearly showed that his decisions in the past were biased in such a way that his political ambitions are supported by those !

I have read your several comments… you are anti SF anti SNF and very critical on certain time with rude language… It is SF or SNF… in this instance can a junior try a senior ??? specially in a place like the army… Like a clerk or manager in an organisation sitting in an internal disciplinary panel trying a Director
There must be a provision in army law about the way a senior has to be tried.

SF is not subject to Miltary law because he is not a commissioned officer. He was on top of the army. Court martial is only for commissioned officers and enlisted soliders. If army commander makes a mistake that will be handled by President by fireing him. What MR is doing are all illegal.
I don’t like Sarath Fonseka, but to have a court martial just days before the General Election is wrong. MR is losing my vote because of things like this. So now I have the task of identifying an honest UNP candidate to vote for.

They are not only scared of SF, they were scared of even letting journalist to the N&E of SL and any foreign negotiators. If they have nothing to hide let the UN have an inquiry.
The court marshall scheduled for 16th march is for talking to Johnstone fernando between 1st October & 14th NoVember. on the phone. apparently according to Johnston SF had asked him to see that SF’s presidential candidature be approved by the UNP working committe. also he had called Johnston from USA & told some derogatory comments about MR. & added that he w ould coem to srilanka as presidentail candidate & to receive him at the airport. He had also spoken by phone to LAKshman seneviratne but L.S’s statement did not say they spoke insultingly of anyone.So mangala samaraweera told during election time that the reason for Johnston crossing over was that he had asked an LTTE cadre to assasinate MR in 2007. This cadre is now in cid custody so he had revealed everything. & that had been why this man crossed over to the govt for after such a matter is discovered he has no option but to be a lackey of the govt in order to hush up the matter . & he has now become one of MR’S FAVOURITES. & Shan Wickramasighe revealed the same information just last week on TNL radio & said he takes full responsibility for his comments & that Johnston could sue him if he wanted to. so who can depend on the reliability of the evidence of this kind of dubious charachter . he will make up any lie to please anybody. How strange it is that MR is now backing him to the hilt. I am just so surprised that no one in the opposition has seen fit to take this matter to court. mangala produced a CD with recorded evidence & said that anyone could get it checked by a forensic expert .Anyway what a travesty of justice it is that the commander of the army that annihilated the ltte is to be court martialled based on evidence given by a pole vaulting SINHALESE mp who allegedly plotted with the LTTE to murder the president. What a travesty of justice it is !
